Legal Issues With Online Gambling
In many countries, online gambling is legal. Nations such as the United Kingdom allow online gambling as long as it is regulated. Many Carribean nations also allow online gambling. At the same time, certain types of online gambling is illegal in certain countries. Sports betting is not allowed in the United States, and is prohibited under the Federal Wire Act. Other types of online gambling in the US is legal.
Despite this, different states in the US have their own laws which relate to online gambling. Some states may require webmasters who have gambling sites to have licenses in order to run them. A recent complaint has been made to the World Trade Organization by Antigua and Barbuda about states in the US which choose to make online gambling illegal. Though the WTO ruled in favor of the island at first, recent changes have been made which may negate this. Though the law stated that certain states have the right to prohibit online gambling, the WTO also indicated that these states may be violating international law.
It has been argued that many of the gambling laws in the US should not be applied towards foreign or national online gambling companies. Many US gambling laws are also inconsistent with policies made by the WTO. Many people have said that the nature of the internet makes it suspect to money laundering and other nefarious activities. Because of high level encryption, it may be difficult to trace certain amounts of money. Google and Yahoo have removed gambling ads from their sites, and the US Justice Department has ruled that the Wire Act applies to online gambling as well as making bets via the telephone.
Despite this, proponents of online gambling feel that making online gambling illegal is a violation of the First Amendment of the US Constitution. Some also feel that online gambling is a threat to traditional institutions, and because of this brick and mortar gambling establishments will lobby government officials to pass laws which favor them. Because the online gambling is a lucrative industry, many feel that the government wants to regulate it so they can profit from it.
Those against online gambling claim that it is an industry which can lead to millions of people becoming addicted to gambling. Those who support online gambling claim that this is a personal choice that players make. A recent bill was proposed in North Dakota to regulate online gambling, but it was defeated. Online gambling is a topic which is likely to be heavily debated in the future. Though problems with addiction may exist, the same can be said for offline casinos.
